Rick James Hodge, 42, of Appomattox, was convicted on two counts of assault and battery (third or subsequent offense) in a bench trial before Circuit Court Judge Andy Nelson.
Hodge is scheduled to return to Appomattox County Circuit Court on June 17 for sentencing. He had pleaded not guilty to the charges and requested the bench trial. In a bench trial, the verdict is decided by the judge with no jury present.
According to evidence presented in court, including testimony of the victim, a female witness and a police deputy, Hodge was involved in a dispute at around 9 p.m. Oct. 5, 2020, in Appomattox County.
The victim, a female, had informed Hodge that he was expected to move out of their shared residence because he allegedly was not fulfilling his financial obligations there. Testimony stated that he had received a 30-day notice of eviction prior to the incident.
